Contractor’s Liability Insurance

Contractors Liability Insurance is almost always required by contract before any operations begin.

Bodily injury and property damage are some of the main hazards contractors face, and they are liable both before and after a job is complete. Contractor General Liability covers:

  • Premises/Operations:  This portion pays for all bodily injury and/or property damages that take place while an operation is in progress. The policy will cover various "perils", or problems that can result in damages. The insurance will pay for perils that arise from ownership, maintenance, or use of premises. You are also covered when principal business operations are performed away from your premises.
           
  • Completed Operations: This portion of your liability insurance covers possible liability for bodily injury and/or property damage after your work is complete and you have left the job site.


Insurance requirements:


General contractor liability insurance is a must for every contractor, since claims regarding property damage and personal injury on account of negligence cannot be ruled out, both during the course of work and after the completion of the project.


It helps to protect the contractor from accidents, contractual liability, and law suits that may result from contracted work. Insurance can help contractors save money on attorneys, who may be employed during the course of litigation, since the insurance company has its own lawyers who are eager to win the case or work out a feasible alternative. A general contractor needs to be equipped with general contractor liability insurance that provides protection against claims with regard to property damage, personal injury or negligence.

There are exclusions that bar coverage for damages that may arise on account of faulty workmanship, provided the damage occurs prior to the completion of the construction project.
Typically, a general contractor is not responsible for the subcontractor's mistakes. However, attorneys for subcontractors have found loopholes that allow them to sue the general contractor for negligence. It is advised that before hiring subcontractors, the general contractor needs to ensure that the subcontractor has general liability insurance.
The cost of contractors general liability insurance varies depending upon the level of risk, the nature of work, the payroll expenses, the gross receipts of the company and the amount of coverage required.

Most contractors are required to have Contractors General Liability Insurance by their:

  • Clients
  • Government regulations or a government agency employing your company
