What is Business Liability / Commercial General Liability Insurance?

Commercial General Liability Insurance Protects Your Business From Common Liabilities. Businesses face liabilities every day. A Commercial General Liability (CGL) insurance policy protects the assets of a business when it is sued for something it did (or did not do) which caused an injury or property damage.

General Liability insurance covers claims of bodily injury or other physical injury or property damage. It is frequently bundled in a package with Property insurance, known as a Business Owners Policy (BOP), to protect your business against incidents that may occur on your premises or at other covered locations where you normally conduct business. Commercial General Liability enables your business to continue operations while it faces claims of certain types of negligence or wrongdoing.

Commercial General Liability Insurance Overview

The most common form of liability insurance that all businesses should have is Commercial General Liability. CGL policies cover claims in four basic:

  • Bodily Injury
           
  • Property Damage
  • Personal Injury (including slander or libel)
           
  • Advertising Injury

In addition to covering the claims listed above, Commercial General Liability policies also cover the cost to defend or settle claims - even if the claims are fraudulent.

Business Liability insurance protects your business against financial loss resulting from claims of injury or damage caused to others by you or your employees. (Some coverages may not be available on all policies or in all states.)

  • Additional Insureds:  Coverage is provided when required in a written contract, agreement or permit. (Additional fees may apply)
           
  • Personal and Advertising Injury:  Covers you for certain offenses you or your employees commit in the course of your business, such as libel, slander, disparagement, or copyright infringement in your advertisements.
           
  • Employment Practices Liability:  Covers claims, including legal defense costs, for certain employment-related lawsuits brought against you by your employees or job applicants.
           
  • Defense Costs:  Pays legal expenses for certain liability claims brought against your business regardless of who's at fault.
           
  • Medical Expenses:  Pays the applicable medical costs if someone is injured and needs medical treatment due to an accident on your premises.
           
  • Products-Completed Operations:  Provides coverage protection for your company's completed products or services. This means that, if an injury ever resulted from something your company made or some service your company provided, your policy would pay for the resulting damages and any legal expenses (up to your policy's limit). And if you were sued because of these damages, your policy would cover related defense costs regardless of who was at fault -- in addition to your policy's limit.
           
  • Premises and Operations Liability:  Provides coverage for bodily injury and property damage sustained by others at your premises or as a result of your business' operations.
           
  • Tenant's Liability:  Protects your business against claims of damage due to fire or other covered losses caused by you to premises that you rent.

Why Do I Need Business Liability / Commercial General Liability Insurance?

Business Liability Insurance Keeps You In Business.
Every business benefits from adequate Commercial General Liability coverage. CGL insurance protects you if a customer is injured at your place of business. It would also cover damage or injuries caused by your employees at a client's site.
Commercial General Liability protects businesses against these types of claims. Even if your company is negligent or liable for damage, injury or loss to another's property, reputation or health, your business can keep its assets if it is adequately insured.


 Most businesses are required to have Commercial General Liability Insurance by their:

  • Landlord
           
  • Clients
  • Government regulations or a government agency employing your company

In order to protect themselves and their investments, many clients and landlords of large or small businesses require CGL coverage by contract.

Who This Policy Would Cover

The General Liability policy extends liability protection to a number of people involved in your business.

  • If your business is a partnership or joint venture, this policy would cover all partners or members and their spouses -- but only if they're sued because of something they did while acting in an official capacity for your business.
           
  • If your business is a corporation or association, this policy would also cover all executive officers, directors, and stockholders -- while acting in these official capacities.
           
  • Your employees would also be protected -- while they are acting in their capacity as employees.
  • Any person or organization, such as a vendor, with whom you have a written agreement to indemnify, would also be protected against liability claims for any bodily injury or property damage that results from distributing or selling your products.
  • Your legal representatives would also be afforded liability coverage under this policy -- for any liability arising from the maintenance or use of your property in their care.
  • While acting under your direction and within the scope of their responsibilities for you, any volunteers for your business would also be extended liability coverage.

What Expenses This Policy May Cover

A General Liability policy is designed to provide financial protection in case your business is ever sued or held legally responsible for some injury or damage. Typical expenses this policy may cover include:

  • Amount the insurer spends to investigate or defend the claim or suit brought against you
           
  • Other costs incurred directly by the insurance company, such as attorney's fees, witness fees, and police report costs
           
  • Any court costs or other costs assessed against you in a suit
           
  • Reasonable expenses you incur at the insurance company's request to aid in your defense against a claim (such as your loss of income for a day spent in court)
  • Any judgment or settlement arising from a covered suit
           
  • Any required interest on the judgment if the defense is unsuccessful
           
  • Medical expenses for injured parties
           
  • Premiums for any bonds required by a liability suit

Commercial General Liability Only Protects Against Some Business Liabilities.

General Liability insurance does not protect your business against every liability. If you or your employees make professional judgments and recommendations in the course of your business, ask your agent or broker about a Professional Liability policy in addition to a CGL policy.

Professional Liability insurance (also known as Errors and Omissions, or E&O coverage) is a separate type of insurance that protects your business against loss from a claim of alleged negligent acts, errors or omissions in the performance of your professional services. Professional Liability insurance is another important type of coverage critical in protecting your business from financially devastating claims.

Completing Your Package:

Commercial General Liability insurance is often not comprehensive enough to cover every eventuality, and other insurance plans are required by law and for complete protection. Most business owners who purchase General Liability insurance from Intellisurance also purchase:
