What is Workers’ Compensation Insurance?

Workers Compensation Insurance is required by law in most states when you have W2 employees. In some states the requirement may include that you cover your 1099 contractors. Workers Compensation insurance covers your employees' lost wages and medical expenses related to work-related illness and on-the-job injuries Workers Comp.  In some states, owners, officers, partners and other principals can decline to participate in their own companies' workers' compensation coverage.

What does Workers’ Compensation Cover?

An employee is automatically entitled to receive certain benefits when he/she suffers an occupational disease or accidental injury during or due to employment. Such benefits may include:

  • Cash or wage-loss benefits
           
  • Medical and career rehabilitation benefits
           
  • In the case of accidental death, benefits to dependents

A worker whose injury is covered by workers compensation loses the common-law right to sue his/her employer for that injury. However, injured workers may still sue third parties whose negligence contributed to the work injury. Many jurisdictions permit employers or insurers to sue negligent third parties on their employee`s behalf in order to recover funds paid as workers compensation benefits.

Whether the employee or employer is at fault for the injury is usually inconsequential, as the sole goal of workers compensation is to return the injured employee quickly and economically to productivity.

Workers compensation benefits typically exclude:

  • Independent contractors
           
  • Domestic and agricultural workers in some states
